1. SCOPE
These terms and conditions and customer information apply to all contracts you enter into with us, MYMAR, via www.mymar.de. Unless the parties have agreed otherwise, your deviating, conflicting or supplementary general terms and conditions, even if known, shall not become part of the contract. However, individual agreements between the parties shall always take precedence.

2. DELIVERY / PRICES / SHIPPING COSTS
We deliver only within the Federal Republic of Germany and EU with DHL to your home address or to a different address. Unfortunately, deliveries abroad are not possible. Please take the delivery time from the respective article offer.
All prices are total prices in Euro, i.e. they include all price components as well as the statutory sales tax. In addition to the prices shown, we charge a flat rate of 4.99 Euro per order for standard deliveries in Germany ( prices may vary for other countries).
3. CONCLUSION OF CONTRACT / CONTRACT LANGUAGE / CORRECTION OF INPUT ERRORS
The presentation of the articles does not constitute a legally binding offer, but an invitation to you to submit a binding offer to us. You can make this offer to us by placing the desired items in the virtual shopping cart (click on “Add to Cart”), pressing the “Shopping Cart” button, going through the shopping cart process and submitting the order with the items placed in the shopping cart (click on the “Buy” button). After receipt of your order in the online store, you will automatically receive an e-mail that documents your submitted offer (order). This e-mail merely confirms that we have received the order; it does not constitute a contract. An effective contract is only concluded if we accept your offer within five days by requesting payment after placing the order, by confirming the order by e-mail or telephone or by delivering the goods.
The contract shall be concluded exclusively in German. You can correct input errors before submitting your order using the technical means provided in the online store as well as the usual functions of your keyboard/mouse. You can also cancel the process at any time by closing the browser window. By clicking the “Buy” button you have made a binding order (offer); input errors can not be corrected afterwards.
4. TERMS OF PAYMENT
You have the possibility to choose between the following payment methods:
Invoice: We offer the purchase on account via the partner Payone GmbH, for this we assign the claim to Payone GmbH. You pay after receiving the invoice by bank transfer within 14 days directly to Payone GmbH. PAYONE is a product of PAYONE GmbH, Lyoner Straße 15,60528 Frankfurt am Main. We refer to the General Terms and Conditions of PAYONE.
Credit card (VISA, Master Card): Your credit card will be charged upon completion of your order.
PayPal: You pay the invoice amount via the online provider PayPal directly through your PayPal account. To do this, you must be registered there or register first. After submitting your order, you will be redirected to the PayPal page, log in and release the payment there. PayPal will then process the payment immediately afterwards. You will receive further instructions during the ordering process. We refer to the terms and conditions of Paypal.
5. RESERVATION OF OWNERSHIP
Until full payment, the delivered goods remain the property of MYMAR represented by Sandra Mihajlovic.
6. CANCELLATION POLICY FOR CONSUMERS
If you are a consumer – according to § 13 BGB (German Civil Code) a consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed – the following right of withdrawal applies to you:.
Right of withdrawal
You have the right to cancel this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, have taken possession of the last goods.
To exercise your right of withdrawal, you must inform us (MYMAR, Am Felsenkeller 9, 63505 Langenselbold, phone: + 49 176 61 45 45 22, e-mail: info@mymar.de) by means of a clear statement (e.g. a letter sent by mail or an e-mail) about your decision to withdraw from this contract.
In order to comply with the withdrawal period, it is sufficient that you send the notification of the exercise of the right of withdrawal before the expiry of the withdrawal period.
Consequences of the revocation
If you cancel this contract, we must return to you all payments we have received from you, including delivery costs (with the exception of additional costs resulting from the fact that you have chosen a type of delivery other than the cheapest standard delivery offered by us), without delay and at the latest within fourteen days from the day on which we received the notification of your cancellation of this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged for this repayment. We may refuse to refund you until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier.
You must return or hand over the goods to us immediately and in any case no later than within fourteen days from the day on which you notify us of the cancellation of this contract. The deadline is met if you send the goods before the deadline of fourteen days.
We bear the cost of returning the goods. You only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary for testing the condition, properties and functioning of the goods.
Exclusion of the right of withdrawal
According to § 312g paragraph 2 BGB, the right of withdrawal does not apply to the following contracts:
Contracts for the supply of goods that are not prefabricated and for the manufacture of which an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer (§ 312g paragraph 2 No. 1 BGB),
Contracts for the delivery of sealed goods that are not suitable for return for reasons of health protection or hygiene, if their seal has been removed after delivery (§ 312g paragraph 2 No. 3 BGB).

8. PRODUCT CUSTOMIZATION – LIABILITY / THIRD PARTY RIGHTS
If you make use of our offer of product customization, you ensure that the content provided by you for this purpose does not violate copyrights, trademarks or other rights of third parties and that you are the owner of all necessary rights. We expressly point out that a corresponding check is not carried out by us. If third parties assert claims against us due to the infringement of their rights, you shall indemnify us against all claims and obligations in this regard upon first request and reimburse us for the reasonable costs of a legal defense.
9. STORAGE OF THE TEXT OF THE CONTRACT
The text of the contract will be stored by us and sent to you by e-mail immediately after you have submitted your offer to conclude a purchase contract together with the General Terms and Conditions. If you have registered for the customer account in the online store before completing the shopping cart process, you can also access the text of the contract via the customer account after entering your access data for a period of 6 months, as long as you do not delete your customer account or have it deleted by us. Furthermore, you can print the offer data immediately after submitting the order.
10. COMPLAINT PROCEDURE/DISPUTE RESOLUTION
The EU Commission provides a platform for out-of-court dispute resolution. This gives consumers the opportunity to initially resolve disputes related to their online order without having to go to court. We shall endeavor to settle any disagreements arising from our contract with the customer amicably. Furthermore, we are not obligated to participate in any arbitration proceedings and unfortunately cannot offer our customers participation in such proceedings.
11. APPLICABLE LAW
The law of the Federal Republic of Germany shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG). However, this choice of law shall only apply to the extent that the protection granted is not withdrawn by mandatory provisions of the state in which the consumer has his habitual residence.
